Welcome to Curated By. These Terms & Conditions (“Terms”) govern your access to and use of the Curated By website and any purchases made through it. By accessing our site or placing an order, you agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our website or place an order.

1. About Curated By
Curated By operates as a curated marketplace connecting customers with independent designers from around the world.

When you place an order through our website, you acknowledge that you are purchasing directly from the designer. Designers are responsible for production, fulfillment, and shipping. Curated By acts solely as an intermediary platform and does not hold inventory or manufacture products.

2. Eligibility & Website Use
By using this website, you confirm that you are at least 18 years old or have legal parental consent and that you will not use the site for unlawful purposes.

3. Product Information & Availability
Product descriptions are provided by designers. Due to the artisanal nature of many items, variations may occur. Availability is not guaranteed.

4. Pricing & Payments
Prices do not include shipping, duties, taxes, or customs fees unless explicitly stated. Payments are processed securely through Shopify Payments and/or Stripe.

5. Shipping & International Orders
Orders are fulfilled and shipped directly by designers. Shipping timelines are estimates and may vary. Customers are responsible for any import duties, taxes, or customs fees.

6. Final Sale & Refunds
All sales are considered final. Refunds are not offered for change of mind, sizing issues, shipping delays, customs fees, or refused deliveries. Curated By does not offer refunds directly.

7. Damaged or Defective Items
If an item arrives damaged or defective, customers must notify us within 5 days of delivery with photos. Designers may offer a repair, replacement, exchange, or store credit at their discretion.

8. Non-Refundable Costs
Shipping fees, import duties, taxes, and customs charges are generally non-refundable, as they are paid to third parties and outside of Curated By’s control.

9. Data Collection & Communications
By submitting a form or placing an order, you may provide personal information such as your name, email address, or phone number. By doing so, you consent to receive communications from Curated By, including emails and SMS messages related to updates, events, and curated news. Message frequency may vary. Standard messaging and data rates may apply. You may unsubscribe or opt out at any time.

10. Intellectual Property
All site content is the property of Curated By or its partners and may not be used without permission.

11. Limitation of Liability
Curated By is not liable for shipping delays, customs issues, or acts of third parties. Liability is limited to the amount paid for the applicable order.

12. Governing Law
These Terms are governed by the laws of the State of Florida, United States.

13. Consumer Rights Notice
Nothing in these Terms limits or excludes rights granted under applicable consumer protection laws.

14. Changes
